Foreclosure Bailout Loans for Commercial and Investment Property
A foreclosure bailout loan is a short-term, equity-based private money loan that pays off a foreclosing lender before the sale date. As a Senior Mortgage Broker, I connect owners of commercial and investment property, in every state, with foreclosure bailout lenders who look first at the property's equity, not the borrower's credit history.
What is a foreclosure bailout loan?
A foreclosure bailout loan is a new loan secured by your property that pays off the defaulted mortgage, back interest, fees and liens before a foreclosure sale. Private lenders size it on equity and an exit plan, so credit scores, late payments and past foreclosures are not the main factor in the decision.
Banks and agency lenders usually will not refinance a loan that is already in default. Private money lenders work differently. They are investors who lend against real estate, so the questions they ask are about the property: what it is worth, what is owed against it, and how the new loan will be paid off. That is why a bailout can close when a conventional refinance cannot.
Who qualifies for a commercial foreclosure bailout?
Owners of commercial and investment property who have meaningful equity and a realistic exit usually qualify. Most bailout lenders want the total payoff to land at roughly half of the property's current value or less. Not everyone will qualify. Individuals, LLCs and corporations can borrow, and a personal guaranty may be requested.
Common borrowers include landlords behind on a rental, owners of mixed-use or office buildings, investors stuck mid-rehab, and business owners whose building secures a defaulted note. The more equity cushion there is, the more options lenders will offer. Very thin equity often means bringing cash to closing or selling instead.
Which property types can be refinanced out of foreclosure?
Nearly any income or investment property can be considered, including 1 to 4 unit rentals, apartment buildings, mixed-use, office, retail, industrial and warehouse space, hotels, gas stations, restaurants, land and special-purpose buildings. Property condition matters less than value, because the lender is underwriting the real estate itself.
Investment homes and condos owned as rentals count as business-purpose loans and can be done nationwide. If you live in the property as your primary home, owner-occupied primary-home bailouts are offered in Florida only, because those loans follow consumer lending rules. Call me and I will tell you where your situation fits.
How fast can a foreclosure bailout loan close?
Private money can close much faster than a bank, often in a few weeks and sometimes sooner when title, payoff letters and a valuation are ready. Speed depends on how quickly the foreclosing lender issues a payoff and how clean title is, so the earlier you call, the more room you have.
The biggest delays are missing payoff statements, unrecorded liens, and judgments that surface in the title search. Gather your mortgage statements, the foreclosure notice or complaint, any lease or rent roll, and recent photos before your first call. If a sale date is very close, also talk to an attorney about your options.
How much can you borrow against the property?
Loan size is driven by loan-to-value. For foreclosure bailouts, lenders commonly cap the new loan near 50 percent of current value, sometimes higher on strong properties and purchases. Not everyone will qualify. The payoff, liens, closing costs and any required reserves all have to fit inside that number.
Here is how that works in practice. The lender starts with the property's current value and applies its loan-to-value limit. Everything that has to be paid at closing, including the payoff, back interest, liens and costs, must fit under that limit. If it does not, the owner brings the difference or the deal is restructured. I will give you a straight answer early so you do not lose time.
What does a foreclosure bailout cost, and what is the exit?
Bailout loans cost more than bank loans because they carry more risk and close quickly. Expect higher interest, lender points and a short term, often around two years. Every lender needs an exit, usually a sale, a refinance into a DSCR or bank loan, or a lease-up that improves cash flow.
I do not publish rates or fees because they change by deal. You will see full written terms before you commit. A good bailout buys time to sell on your terms or stabilize the property, rather than losing the equity at auction.
How does working with a mortgage broker help?
A broker shops your scenario to multiple private money lenders instead of one. I package the property, payoff and exit plan, then bring back the options that fit. I arrange financing; I do not buy property or provide legal advice, and no outcome is guaranteed.
Because I also arrange DSCR loans in 38 states, I can plan the long-term refinance out of the bailout loan from day one. That planning is what keeps a short-term loan from turning into a second crisis.
Frequently asked questions
What is a foreclosure bailout loan?
A short-term, equity-based private money loan that pays off a defaulted mortgage and related liens before a foreclosure sale. It is underwritten mainly on the property's value and the exit plan.
Can I get a foreclosure bailout loan with bad credit?
Often, yes. For commercial and investment property, credit scores and past foreclosures are not the main factor; equity and a realistic exit are. Approval is never guaranteed.
How much equity do I need?
Many bailout lenders cap the loan near 50 percent of current value, so the total payoff, liens and costs generally need to fit within about half of what the property is worth. Not everyone will qualify.
Do you offer foreclosure bailout loans nationwide?
Yes for commercial and investment (business-purpose) property. Owner-occupied primary homes are offered in Florida only.
Can an LLC or corporation borrow?
Yes. Individuals, LLCs and corporations can borrow. Lenders may ask the owner for a personal guaranty.
How long is the loan term?
Bailout loans are short-term, commonly around two years, with the expectation that you sell or refinance before the term ends.
Will a bailout loan stop my foreclosure?
Only if it closes and pays off the lender before the sale. I cannot guarantee timing or results. If your sale date is close, also speak with a real estate attorney.
